“The Court Doesn’t Have The Right To Remove Me From Power” – Governor David Umahi

Governor of Ebonyi state, David Umahi said he would appeal the decision of the Federal High Court in Abuja who sacked him because he defected or ported to APC.

“We will file an appeal against this useless judgement,” Governor David Umahi said, and added, “I am still the governor of Ebonyi State.”

On Tuesday, the Abuja High Court declared the porting of the Ebonyi state governor and his deputy governor illegal, null and unconstitutional.

This judgement was based on the case which PDP filed to ask for the removal of the governor and his deputy from office.

On the grounds that it was PDP that won the election in March 2019 and not the candidate, Justice Ekwo gave an order to sack them.

Court Sacks Governor David Umahi, Deputy For Joining APC, Orders PDP To Produce Replacement Immediately

He quoted section 221 of the constitution and immediately ordered the PDP to send names of people who would replace them to INEC to conduct fresh elections.

In the ruling, the Justice also ordered INEC to stop recognising David Umahi and Eric Igwe as Governor and Deputy of Ebonyi State respectively.

But in a press briefing that the governor did with local reporters, Dave Umahi said the court did not have the power to remove him from office.

“There are three ways a governor could be removed from his seat: by vet, resignation, or impeachment by the House of Assembly

“No other constitutional provision exists which empowers a hatchet man to turn the law and the constitution upside down. I have listened to the judgement of Ekwo and it is obvious that he is on a mission,” he added.

“The ruling this afternoon is clear evidence that this country is in trouble,” he said.
